Deloitte-ILF Lecture "Messing with the Regulator" held on 28 November 2024

On Thursday, 28 November 2024, the Institute for Law and Finance, in cooperation with Deloitte Legal, hosted the Deloitte-ILF Lecture "Messing with the Regulator", inspired by the dissertation with the same title written by Dr. Sonja Heitzer, LMU. In her dissertation, Dr. Heitzer investigates the phenomenon which has been observed for decades that, at least in Germany, legal disputes between credit institutions and the supervisory authority, i.e. BaFin, are remarkably rare in court.

The evening began with welcoming remarks by Dr. Hendrik Haag, Member of the Executive Board of the ILF, and Dr. Mathias Hanten, Partner of Deloitte Legal and Member of the ILF Donors' Committee.

In her lead-in "Messing with the Regulator - Judicial Review in Banking Supervision", Dr. Sonja Heitzer presented the topic and contents of her dissertation and concluded that messing with the regulator poses a challenge for all parties involved: banks, regulators, legislators, courts and legal scholars.

The following panel disussion started with initial statements from the panelists, representing the perspectives of banks, regulators and academia repectively. The panel consisted of Dr. Sonja Heitzer, Dr. Denise Bauer-Weiler, UBS SE, Dr. Klaus Lackhoff, European Central Bank and Prof. Dr. Ann-Katrin Kaufhold, LMU and was moderated by Dr. Mathias Hanten. At the end of the panel discussion, the audience had the opportunity to ask questions and provide comments from their perspectives on the discussed topic.

The evening concluded with a get-together where speakers, ILF students and alumni as well as participants from academia and the financial industry were able to discuss further on the topic presented and network with one another.
